Terms of Service — AithosAI

These Terms of Service ("Terms") govern your access to and use of the AithosAI mobile application (the "App"), operated by AithosAI ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to these Terms.

If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 16 years old to use AithosAI. By using the App, you represent that you meet this requirement and that the information you provide is accurate.

2. Your Account

To use the App you create an account with your email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

You may delete your account and associated data at any time from within the App via Profile → Settings → Delete Account.

3. What AithosAI Provides

AithosAI offers AI-assisted fitness and nutrition tools, including physique scoring (the Aithos Index™), meal nutrition analysis, and an AI coaching assistant. These features rely on artificial intelligence and produce estimates, not guaranteed or clinically precise results.

Not medical advice. The Aithos Index™, FFMI calculations, nutrition estimates, and all AI-generated coaching content are for informational and motivational purposes only. They are AI-estimated and are not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any fitness, nutrition, or supplementation program. You use this information at your own risk.

4. Subscriptions and Payments

AithosAI offers an optional paid subscription, "AithosAI Pro," available as a monthly or annual plan. Subscriptions are processed exclusively through Apple's In-App Purchase system, subject to Apple's terms.

Payment is charged to your Apple ID account upon confirmation of purchase.
New subscribers may be offered a free trial period. If you do not cancel before the trial ends, the subscription automatically converts to a paid subscription.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
You manage or cancel your subscription in your Apple ID account settings. Deleting the App does not cancel a subscription.
Except where required by law, payments are non-refundable. Refund requests are handled by Apple.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms;
Upload photos of anyone other than yourself without their consent, or any content that is unlawful or infringing;
Attempt to reverse-engineer, decompile, or bypass any security or usage limits of the App;
Interfere with or disrupt the App or its underlying infrastructure.

6. User Content

You retain ownership of the photos and information you submit ("User Content"). You grant us a limited license to process your User Content solely to operate the App and provide your results, as described in our Privacy Policy. We do not use your photos to train third-party AI models.

7. Intellectual Property

The App, including the Aithos Index™, its scoring system, tier framework, design, and all related content, is owned by AithosAI and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that AI-generated results are accurate, complete, or suitable for your circumstances.

9. Limitation of Liability

To the maximum extent permitted by law, AithosAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of, or inability to use, the App — including any decisions made based on AI-generated fitness or nutrition information. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Changes to the App or Terms

We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time; material changes will be communicated through the App or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Canada and the province in which AithosAI operates, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located there.
